PALM COAST PARTY RENTALS
RENTAL AGREEMENT AND TERMS & CONDITIONS
This Rental Agreement ("Agreement") is entered into between Palm Coast Party Rentals ("Company") and the undersigned customer ("Renter"). By signing this Agreement, the Renter agrees to all terms and conditions set forth herein.
1. PAYMENT TERMS
A security deposit equal to fifty percent (50%) of the total rental amount is required at the time of booking to reserve rental equipment and event dates.
The remaining balance must be paid in full no later than forty-eight (48) hours prior to the scheduled pickup date and time.
Failure to pay the remaining balance by the due date may result in cancellation of the reservation and forfeiture of all deposits paid.
Palm Coast Party Rentals reserves the right to withhold rental equipment until all outstanding balances have been paid in full.
2. CANCELLATION & RESCHEDULING
Reservations canceled less than three (3) calendar days before the scheduled rental date shall result in forfeiture of the security deposit.
Requests to reschedule must be submitted at least three (3) calendar days before the rental date and are subject to inventory availability.
Palm Coast Party Rentals reserves the right to approve or deny rescheduling requests at its sole discretion.
3. EQUIPMENT INSPECTION & ACCEPTANCE
The Renter acknowledges receipt of all rental items and agrees to inspect all equipment immediately upon pickup.
The Renter shall notify Palm Coast Party Rentals immediately of any missing items, defects, damage, malfunction, or condition that may prevent the intended use of any rental item.
Failure to notify Palm Coast Party Rentals prior to use shall constitute acknowledgment and acceptance that all rental items were received in good condition, clean, functional, complete, and suitable for their intended purpose.
The Renter understands that failure to report damage or defects at pickup may result in the Renter being held responsible for any damage identified upon return.
Palm Coast Party Rentals may photograph rental equipment before pickup and after return to document condition.
4. EQUIPMENT USE & RETURN
The Renter assumes full responsibility for all rental equipment from the time of pickup until return and inspection by Palm Coast Party Rentals.
The Renter agrees to:
- Use all equipment only for its intended purpose.
- Follow all instructions provided by Palm Coast Party Rentals.
- Protect equipment from theft, weather, misuse, pets, food spills, and unauthorized use.
- Return all equipment on or before the agreed return date and time.
- Return all equipment in substantially the same condition as received, excluding normal wear and tear.
Late returns may result in additional rental charges.
5. DAMAGE, LOSS & REPLACEMENT COSTS
The Renter shall be financially responsible for any damaged, destroyed, lost, stolen, stained, altered, or missing rental equipment occurring during the rental period.
Palm Coast Party Rentals may deduct repair, cleaning, replacement, or late fees from the security deposit.
If repair or replacement costs exceed the security deposit amount, the Renter agrees to pay the remaining balance within ten (10) days of receiving written notice.
Replacement costs shall be determined based upon current market value.
6. ASSUMPTION OF RISK
The Renter acknowledges that party equipment, tents, inflatables, games, concession equipment, furniture, and related rental items may involve inherent risks.
The Renter voluntarily assumes all risks associated with the possession, transportation, setup, operation, supervision, and use of rental equipment.
The Renter is solely responsible for ensuring proper supervision and safe operation during the rental period.
7. RELEASE OF LIABILITY
To the fullest extent permitted by law, the Renter releases and holds harmless Palm Coast Party Rentals, its owners, employees, agents, representatives, and contractors from any claims, demands, liabilities, damages, losses, injuries, illnesses, death, property damage, costs, or expenses arising from or related to the use, misuse, transportation, possession, installation, or operation of rental equipment.
8. INDEMNIFICATION
The Renter agrees to defend, indemnify, and hold harmless Palm Coast Party Rentals from any claims, lawsuits, judgments, liabilities, attorney fees, or expenses arising from:
- Use of rental equipment;
- Violation of this Agreement;
- Negligence or misconduct of the Renter or guests;
- Injury or property damage occurring during the rental period.
9. FORCE MAJEURE
Palm Coast Party Rentals shall not be liable for delays, cancellations, or failure to perform resulting from events beyond its reasonable control, including but not limited to acts of God, hurricanes, floods, severe weather, fire, government actions, pandemics, utility failures, labor disputes, transportation disruptions, or other unforeseen circumstances.
In such events, Palm Coast Party Rentals may cancel, delay, modify, or reschedule rentals without liability.
10. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.
Any legal action arising from this Agreement shall be brought exclusively in the appropriate courts located within the State of Florida.
